Going out on a Friday night or on the weekends for a few drinks is something most people over the age of 21 do fairly often. Most of the time, we are meeting up with friends, having a girls or guys night out, and just enjoying ourselves. Back in 2012, however, this typical chain of events took a turn for the worse when a high-profile patron at a Dallas nightclub was overserved, resulting in a horrific car accident.
Recently, a Dallas jury returned a $25 million wrongful death verdict against Beamers Private Club in Dallas after finding the establishment overserved alcohol to former Dallas Cowboys defensive tackle, Josh Brent. Brent would ultimately go on to leave the club and crash his Mercedes, killing his teammate Jerry Brown who was a passenger in the car at the time.
Jurors deliberated for five hours prior to finding the defendants associated with Beamers Private Club and their VIP section of the bar called the Private Lounge negligent in allowing Brent to consume more alcohol than necessary. Investigators determined Brent drank at least 14 alcoholic beverages that night, driving his blood alcohol level up to two times the legal limit.
Josh Brent was reportedly driving at 110 mph in a 45 mph zone, ultimately flipping his Mercedes S60 on an Irving highway. Jerry Brown died from injuries sustained in the crash. In a separate 2014 criminal case, Brent was convicted of intoxication manslaughter and sentenced to just one year in prison.
The Texas Dram Shop Act holds businesses accountable for continuing to sell alcohol to persons who are obviously intoxicated. The plaintiff seeking to sue the establishment must prove the offending driver was obviously intoxicated to the extent he or she was a danger to themselves or the public when they were served the alcohol.
