Recovery Motor Vehicle Accident (leg amputation)

Ted Liggett was hired to represent a man in his mid-20s who suffered catastrophic injuries in a Motor Vehicle Accident. This young man sustained damage to his entire body, the worst of which resulted in the loss of a leg above the knee.

Ted’s client had stopped his pickup in traffic, preparing to turn onto a side road. While stopped, he was suddenly and unexpectedly hit from behind. He was struck by a gentleman who was traveling well beyond the speed limit and who was distracted by talking on his cell phone. The force of the blow forced the pickup into oncoming traffic, where it was struck a second time from the front by an 18 wheeler.

The client lay in a coma for a length of time before regaining consciousness. Subsequently, he endured months of rehabilitation. Finally, he was fitted with a prosthetic leg and released from his doctors’ care. Initially, the defendant insurance company failed to properly evaluate the case. The suit was filed and months of intense litigation ensued. Ultimately, Ted’s tireless work led to a settlement prior to trial in the amount of $3,000,000.00.

Recovery – Oilfield Accident (broken back)

Ted received a telephone call at his home one evening from the wife of a gentleman who was injured in an oil field accident. She was frustrated because her husband was still hospitalized with a fractured back and she had no one to turn to. Ted visited the couple in the hospital and took the case without hesitation. The defendants claimed the accident was due to the client’s negligence. Ted filed a lawsuit and engaged the services of several experts.

After months of intense and complicated litigation, Ted and his team were able to turn the tide. During mediation, a convincing scenario emerged. Ted presented evidence that illustrated the cause of the accident was the failure of the employers to properly maintain and inspect the oil well.

Recovery – Motor Vehicle Accident, (fractured leg)

Ted Liggett was hired to represent an elderly woman and her young granddaughter. The grandmother suffered debilitating injuries as a result of a motor vehicle accident and her young granddaughter suffered minor scrapes, contusions and, of course, was traumatized by the event.

Although the other party was clearly at fault, his liability carrier theorized that pre-existing conditions related to the grandmother’s age and physical condition were the root of her problems. Ted Liggett filed a lawsuit and through diligent and hard fought steps finally brought this matter to trial. After the jury was seated, the liability carrier finally acquiesced and tendered the sum of $995,000.00 for the grandmother and the sum of $60,000.00 for the young child.

Recovery – Medical Malpractice, (severe injury to fetus)

Ted Liggett was hired to represent a young family who underwent a horrific experience in the birth of their first and only child. This young mother had struggled unsuccessfully for years to have a child. When she was finally able to conceive, she presented to a teaching hospital for care.

The young mother then suffered several instances of malpractice at the hands of her medical providers, who were for the most part young interns and residents training at a teaching hospital under the supervision of an experience physician. Primarily, her doctors misread the diagnostic test and opined that it was an ectopic pregnancy and that the pregnancy must be terminated in order to save her life. This was untrue.

She was then administered drugs, that are commonly used in chemotherapy, to expel the fetus. This was not successful and it was then discovered that there was not an ectopic pregnancy at all. The young mother having struggled to have a child and not being informed of the damage that had been wrought by the drugs administered did not want to terminate the pregnancy. The pharmaceuticals administered to this young mother did not result in the termination of her pregnancy, however, they did result in the birth of a girl child who was blind, almost totally deaf, and severely damaged both physically and mentally.

The damages in this lawsuit were capped at $1,000,000.00, which sum was finally tendered after intensive and laborious litigation.

Confidential Recovery – Sexual Assault on children

Motor Vehicle Accident, (Grade 3 Liver Laceration, C7 fracture and Lumbar 2 transverse process fracture, 4 rib fractures, and pneumothorax)

Ted Liggett was hired to represent a young man who was injured in a motor vehicle accident caused by a gentleman who was under the influence of intoxicating beverages and who was, in fact, driving on the wrong side of the road when he struck the victim head on.

The result of this accident was very serious injuries to Mr. Liggett’s client. Ted struggled with the liability carrier for the at fault party, however, after diligent effort, the carrier finally tendered its policy limits without the necessity of litigation.

Recovery – Jury Verdict, Motor Vehicle Accident, (torn rotator cuff, neck)

Ted Liggett was hired to represent a gentleman who was injured in a motor vehicle accident caused by an under insured driver. Upon settlement with the under insured driver for policy limits, this gentleman presented a claim to his own liability carrier under the uninsured/under insured portion of his policy for his need for future neck surgery. His carrier argued that any future medical damages were not related to the accident.

At trial, Ted presented both orthopedic and neurosurgical experts. These experts testified that his client had “frozen shoulder syndrome” that was tied to the accident. Further, they opined that he indeed was in need of surgery. The defense countered with their own expert that argued any future medical treatment was not related to the accident.

The jury returned a 12-0 verdict for Ted’s client, awarding $290,562.00. After offset of $52,500 due to the settlement of the third party issue, the actual award paid was $238,062.00.

Recovery – Motor Vehicle/Bicyclist, (ruptured spleen)

Ted Liggett was hired to represent a twelve year old boy who, while riding his bicycle, was struck down by a motor vehicle. The young boy testified that the driver of the vehicle was talking on a cell phone or texting when he struck him. The driver of the vehicle testified that the boy darted out and he was unable to stop. The police investigating the accident scene placed fault on Ted’s client, the young boy on the bicycle.

Despite the findings of the investigating officer, Ted uncovered evidence that enabled him to convince the liability carrier for the driver to tender the policy limits of $250,000.00.

Recovery – Jury Verdict, Motor Vehicle Accident, (knee surgery/neck)

Ted Liggett was hired to represent a gentleman who was injured in a motor vehicle accident caused by a young lady who ran a stop sign and collided with his vehicle. Ted’s client underwent an arthrosporic procedure to repair his knee. The orthopedic surgeon that performed the knee surgery believed the patient would require knee replacement surgery in the future.

The liability carrier refused to pay these damages and Ted filed suit. Defense counsel argued that Ted’s client caused the accident and hired an expert that testified the client’s knee injury was chronic in nature and was not related to the accident.

The jury found the defendant was 51% negligent and awarded $238,000.00 in damages. The defense filed for JNOV, arguing against prejudgment interest amounts, but the motion was denied. Their motion for new trial was also denied. After offsets, final judgment totaled $151,837.08.
