Ted was hired by parents of a two year old who was severely injured when she was feverish and coughing so her mother went into the room, gave her daughter 1⁄2 of a children’s chewable pain releiver without issue. Later when she gave her daughter the other half it became lodged in her throat. Her mother tried the Heimlich maneuver without luck. Her stepfather rushed her to the local hospital, where they were able to get the tablet out, and revived her, but not without going almost four minutes without oxygen. She was airlifted to a Hospital where she remained in the ICU for over a week on a ventilator. Then remained hospitalized over a month.
The child suffered severe brain injury secondary to choking leading to a list of complications, numerous tests, and a month in the hospital. Sadly the child had suffered permanent debilitating injuries from Hypoxic Ischemic Encephalopathy due to cardiac arrest after choking, Cardiopulmonary arrest with successful resuscitation, Acute Respiratory failure with Hypoxia, Abnormal Brain MRI, Pneumonia Aspiration, a nasogastric tube, and Dysautonomia.
After being released from the hospital the child underwent months of physical and occupational therapy with little improvement. She was left unable to maintain head in a neutral position, unable to participate in upright postures, or bear weight on lower extremities without total assistance.
Though treatment was and will be ongoing, Ted utilized experts and a video showing what her life is like for the child and her family after permanent brain injury. Ted and team were able to settle during a pre litigation mediation for $2,000,000.00.
Total Recovery: $2,000,000.00
